Terms and Conditions
November 6, 2026
These Terms govern how you buy and use the hosting plans of RHINNO IT SpA. Read them before you buy: you can save or print them from your browser. In this text, “we” means RHINNO IT SpA and “you” means the customer. This English version is a courtesy translation: the Spanish version prevails.
1. Scope
RHINNO IT SpA, RUT 76.787.938-5, located at Manquehue Sur 520, Las Condes, Chile, provides hosting, technical management and web development services.
These Terms apply to the Base, Plus and Pro plans, which you buy through this site. The Elite plan, tailored to each customer, and our other services are agreed in writing, and these Terms apply to them for anything that agreement doesn't cover.
You must be at least 18 to buy a plan. If you buy on behalf of a company, you confirm that you have the authority to represent it.
2. How to buy a plan
Buying a plan takes these steps:
- You choose a plan on the site and fill in the form with your details, your domain and the billing document you prefer: boleta or factura.
- You accept these Terms and the Privacy Policy.
- We email you the next steps and the payment link. If the link isn't available yet, we'll send it later.
- You pay through the link. Your payment concludes the contract.
- We email you a written confirmation of the contract, with a full copy of these Terms.
- We activate the service and notify you that it has started.
3. Payment and copies
You pay on the site of an external payment provider, under its own terms. We don't receive your card or payment method details.
We issue the boleta or factura you chose, using the details you gave us.
If you spot a mistake in your details, before or after paying, write to dev@rhinnoit.cloud and we'll fix it.
We keep your request and the contract confirmation in our email. If you need a copy, ask for it at that same address.
4. Plans and price
The Base, Plus and Pro plans get the same service: only the disk space changes. They run on servers in Chile and cPanel® software.
The disk space and price of each plan are those published on the site at the time you buy, in Chilean pesos and for one year.
If the published price changes later, the change doesn't affect the period you've already paid for.
5. Term and renewal
Each plan lasts one year from the date we notify you that the service has started.
Plans don't renew automatically and we don't make automatic charges. To continue, you need to pay for the next period before the plan expires, at the price published on the site at the time you renew.
If you don't renew, the plan ends when it expires and section 8 applies.
6. Support and what's included
All plans include direct 24/7 support, managed DNS and security, free migration, uptime monitoring and daily backups kept for 30 days.
Direct 24/7 support means you can write to us at any time, any day, by email (dev@rhinnoit.cloud) or WhatsApp (+56 9 6610 7777), and the person who runs your service answers you directly. It doesn't include voice calls. These Terms don't set response or resolution times.
Support covers the operation of your plan: hosting, DNS, security, migration, monitoring and backups.
Managing DNS and security is our own work, and it may rely on third-party tools such as Cloudflare® services. What you buy is that management, not a resale of those services, which are governed by each provider's terms.
We coordinate the migration with you, and you need to give us the access and information it requires.
Monitoring helps us detect outages and act on them. It isn't an availability commitment.
Services not listed in this section, such as custom development, stores built with WooCommerce or Shopify, or monthly maintenance, are agreed separately. A Shopify store runs on Shopify's platform, under its terms, and isn't hosted on these plans.
7. Right of withdrawal (derecho a retracto)
If you buy as a consumer, or as a micro or small company protected by Law 20,416, you have the right of withdrawal (derecho a retracto): you can end the contract without giving a reason within 10 days of entering into it and before the service starts.
The service counts as started when we notify you of that by email or through the channel you choose. From then on you can no longer withdraw.
If we don't send you the written confirmation of the contract, the period extends to 90 days.
To withdraw, tell us through the same channel you used to buy or by writing to dev@rhinnoit.cloud. We'll return what you paid, except for services already provided, as soon as possible and in any case within 45 days of your notice.
8. Ending the contract
You can end the contract at any time by telling us through the same channel you used to buy or by writing to dev@rhinnoit.cloud. We won't ask for more than we required to buy, and we won't make ending the contract depend on paying any outstanding amount.
Apart from the right of withdrawal and the cases set by law, if you end the contract before it expires, the amount paid for the current period isn't returned.
We can end the contract if you seriously breach these Terms and don't fix the problem after we warn you, and in the case described in section 11.
When the plan ends, we stop providing the service. Before that date you need to download your content or ask us for a copy. After that we'll delete it from the server, and existing backups will be deleted once they reach 30 days.
9. Suspending the service
We can only suspend the service, fully or partly, in the cases below and for as long as it takes to resolve them. We'll tell you first and give the reason, unless urgency makes that impossible. In that case we'll tell you as soon as we can.
- A breach of section 10 that puts the server, other customers or third parties at risk.
- An attack, malware or other security incident that affects or may affect your plan, the server or third parties.
- An order from a court or another competent authority.
- A suspension or disabling decided by WebPros, as described in section 14.
10. Acceptable use
You're responsible for your site, its content, your access and what anyone using your account does. You must keep your credentials private, comply with the law and respect the terms of the third parties whose services are used to provide your plan.
You may not use the service to:
- Publish or distribute illegal content.
- Infringe copyright, trademarks or other third-party rights.
- Distribute malware, run phishing or send unsolicited bulk email.
- Attack, probe or access systems, accounts or data without authorization.
- Process personal data without complying with the law.
- Use resources in a way that affects the server or other customers.
- Get around the service's security measures or technical limits.
11. Copyright
You keep all rights to your content, and we only use it to provide the service. You must hold the rights and permissions needed for what you publish.
Under Law 17,336 we have no obligation to monitor the data you store or to actively look for illegal activity. If a court orders us to remove or block content hosted on your plan, we'll comply promptly.
If we receive a notice of alleged infringement that meets the requirements of article 85 U of that law, we'll send it to you in writing, with its supporting documents, within 5 business days.
We may end the contract of a content provider that a court has found to be a repeat infringer of the rights protected by that law.
Court notices under that law are received through the legal representative of RHINNO IT SpA, at Manquehue Sur 520, Las Condes, Chile.
12. Backups
We make daily backups of your hosting and keep them for 30 days. After that they're deleted.
You can ask for a restore through the support channels. These Terms don't set restore times.
Backups are a support measure and don't replace your own copies. We recommend keeping copies of whatever matters to you.
13. Liability
We're liable for the damage we cause by breaching these Terms, as provided by law. Nothing in these Terms limits the rights that Law 19,496 or Law 20,416 give you when they apply to you.
The service depends on networks, equipment and third parties, and it may be interrupted, for example by maintenance or faults. We don't promise continuous availability. We're not liable for unforeseeable events or force majeure (caso fortuito o fuerza mayor), or for what is caused by your content, your systems, your instructions or anyone using your account.
If you buy as a company and those laws don't apply to you, our liability is limited to direct damages and to the amount paid for the current annual period, except for willful misconduct or gross negligence.
You're liable for the damage your content or your breach causes to us or to third parties.
14. cPanel® software
The Base, Plus and Pro plans use cPanel® and WHM® software from WebPros International LLC (“WebPros”). Its license requires us to include the conditions below, which you must accept to use the software. They apply to your use of the software and benefit WebPros, to the extent Chilean law allows. They don't limit the rights that Law 19,496 or Law 20,416 give you against us.
If WebPros asks, we must give it a copy of this contract.
- You may not alter, merge, modify, adapt or translate the software, create derivative works from it, decompile, reverse engineer or disassemble it, reduce it to human-readable form, or use it to develop an application with the same primary functions.
- WebPros owns all rights in the software, its trademarks, its usage data and any suggestions you send it, including intellectual property rights. Some of the rights in the software may be licensed to WebPros.
- WebPros provides the software “as is” and, for itself and its affiliates and licensors, disclaims all express or implied warranties for the software, its third-party components and the data accessed through it, including warranties of title, merchantability, satisfactory quality, fitness for a particular purpose and non-infringement. WebPros doesn't warrant that the software is error-free or will run without interruption.
- To the maximum extent the law allows, WebPros, its affiliates and its licensors aren't liable for lost profits, the cost of substitute goods or services, damages for being unable to use equipment or access data, business interruption, or any other indirect, special, incidental, punitive or consequential damages. Their total liability for direct damages is limited to the greater of the amount paid for the software and USD 1,000.
- You may use the software only on the licensed server and within the license territory, which is the whole world except where its use would breach export control rules.
- Your right to use the software can't exceed the scope or term of our license, and it expires automatically and without notice if that license expires or ends for any reason.
- WebPros may, at its sole discretion, terminate, disable or suspend use of and access to the software if we breach its license or if you breach a provision of these Terms concerning WebPros or the software.
- WebPros is a third-party beneficiary of these Terms as they relate to it and the software, with the right to enforce them directly.
- WebPros may, at its sole discretion, monitor use of the software, use its authentication system, and collect and use its usage data, as set out in section 2.5 of its license. The Privacy Policy describes that data.
- You waive all claims against WebPros and its affiliates arising from being unable to use the software because the license expired or ended, or because WebPros disabled or suspended access. This waiver doesn't cover rights the law makes non-waivable, or your claims against us.
- You can check whether the software is licensed, and get other information about the server's license, at http://verify.cpanel.net/ or at another address WebPros designates.
- You may not give another person, such as an agency or a contractor, access to the software without our written authorization. If we authorize it, you must enter into a contract with that person that includes these conditions and the same restrictions, give them no greater scope or term than your own, check that they're at least 18, and provide a copy of that contract if WebPros asks for it.
15. AI features
This section applies only if your plan gives you access to AI features of the cPanel® software. The WebPros license requires us to include these conditions, and WebPros can enforce them directly:
- Those features are artificial intelligence systems. Their output is probabilistic and may be inaccurate, incomplete, insecure, infringing or unfit for your purpose. You must review it before you use it.
- You may not remove, hide or alter the notices or markings showing that a feature uses artificial intelligence or that content was generated by it.
- You may not use them for prohibited practices or high-risk purposes under Regulation (EU) 2024/1689, to develop, train or evaluate competing systems, or to extract their models, weights or instructions.
- You must not enter personal data, confidential information or trade secrets beyond what the task strictly requires.
- WebPros may store and process your prompts, the output and related metadata for security, abuse prevention, compliance, statistical or auditing purposes.
- For the purposes of that Regulation, WebPros is the provider of those features and you are the deployer when you use them under your own authority.
- You can report faults, incorrect output or misuse to us at dev@rhinnoit.cloud.
16. Personal data
We handle your data as a customer according to the Privacy Policy.
If you host other people's personal data on your plan, such as your store's customers, you are the controller of that data (responsable de datos) and we act as your processor (encargado). We handle it only to host it, back it up, protect it and support you, for as long as the plan lasts and following your instructions. The types of data and of data subjects are those you decide to host.
By accepting these Terms you authorize us, in writing and specifically, to use our infrastructure, backup, security and monitoring providers for this work. We remain answerable to you for it, as provided by law.
We'll keep that data confidential, apply security measures and tell you about any security breach that affects it. When the plan ends, we'll delete or return it as described in section 8.
You must have a legal basis for handling that data, inform the people it concerns and respond to their requests.
17. Changes to these Terms
We may update these Terms because of legal, technical or service changes. We'll publish the new version on the site and email you reasonably in advance.
Changes don't apply to a period you've already paid for, unless you accept them or the law requires them. Your silence isn't acceptance. If you don't agree, you can choose not to renew, or end the contract under section 8.
18. Governing law and complaints
These Terms are governed by the laws of Chile.
The Spanish version prevails. This English version is only a courtesy translation.
If you buy as a consumer, you can file complaints with the local police court (juzgado de policía local) for your home address or ours, as you choose, and you can turn to Chile's National Consumer Service (Sernac). If you're a micro or small company, you can bring the actions Law 20,416 gives you.
In all other cases, disputes go to the ordinary courts of Chile.
If a clause is declared void, the rest remain in force, unless the contract can't stand without it.
